Terms of Service

Effective 15 August 2026

These Terms of Service (“Terms”) are a binding agreement between you and TellMyStay (“TellMyStay”, “we”, “us”, “our”). They govern your access to and use of our website, host dashboard, WhatsApp guest concierge, property welcome pages, and related services (the “Service”). By creating an account, clicking to accept, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are and who may use the Service

TellMyStay is operated from Israel. Contact: tellmystay@gmail.com.

The Service is for short-term rental hosts and their guests. You must be at least 18 and able to form a binding contract. If you use the Service for a business, you represent that you have authority to bind it. These Terms apply to you whether you are a host, a guest, or a visitor of the website.

2. What TellMyStay is, and is not

TellMyStay is software. Hosts store property information and offer guests an AI concierge on WhatsApp, plus an optional welcome page opened by a link.

We are a technology provider only. We are not a property manager, real-estate broker, travel agent, insurer, locksmith, security company, or emergency service. We do not employ hosts. We are not a party to any booking, rental, or lodging agreement. We do not inspect properties, verify listings, or supervise stays.

WhatsApp is a product of Meta Platforms, Inc. Guest messaging on WhatsApp is also subject to Meta’s terms and policies. OpenAI, Google, and other providers we use have their own terms. Outages, blocks, policy changes, or account bans on those platforms are outside our control.

3. Early access, availability, and no SLA

The Service may be offered as early access or with a free plan. Features, limits, and pricing can change. We do not promise uninterrupted, error-free, or timely operation. There is no service-level agreement, uptime guarantee, or guaranteed response time. Meta, WhatsApp, OpenAI, Google, or our hosting providers may delay or fail a message. You must have a backup way to reach guests and to get into the property.

4. Host responsibilities

If you are a host, you are solely responsible for your properties, stays, guests, and content. In particular, you are solely responsible for:

  • The accuracy, completeness, and legality of everything you enter, including Wi-Fi credentials, door and lockbox codes, smart-lock instructions, check-in steps, parking, house rules, photos, voice notes, and imported files.
  • Keeping that information current. Wrong or stale access information can lock guests out or let the wrong person in. That risk is yours.
  • Complying with law, booking-platform rules (including Airbnb, Booking.com, and similar), leases, HOA rules, licensing, tax, safety, and accessibility duties.
  • Having a lawful basis to give us a guest’s name, phone number, email, or stay dates, and to have the concierge message that guest on WhatsApp. You must not add a number for anyone who has not agreed to be contacted, or for a child.
  • How you share WhatsApp threads and welcome-page links. A welcome-page URL may reveal property details (including access-related information) to anyone who opens it. Treat those links as confidential. Do not post them publicly.
  • Reviewing what the AI may say. You must not rely on it as the only source for access codes, safety, or anything that could cause harm, loss, or a dispute. You remain the point of contact for exceptions, money, bookings, and emergencies.
  • Your own insurance. The Service is not a substitute for host or liability insurance.

5. Guest use

If you are a guest, you use the WhatsApp concierge and welcome page at your own risk. Replies are generated from information the host supplied and may be incomplete, outdated, or wrong.

For anything urgent (safety, medical help, fire, crime, lockouts, flooding, gas, or security) contact the host and local emergency services. Do not rely on the AI concierge.

Your stay, payments, deposits, damages, house rules, and disputes are between you and the host (and, if applicable, the booking platform). TellMyStay is not responsible for the property, the host, or other guests.

6. Artificial intelligence

The concierge uses artificial intelligence. Outputs can be wrong, invented, outdated, biased, or unsafe even when the host’s notes are correct. Guests may try to trick the model. We do not warrant that the concierge will refuse every bad request or that it will never reveal information the host entered.

The Service is not legal, medical, safety, financial, or other professional advice. It must not be the sole source for access codes, life-safety instructions, or compliance decisions.

We may limit, filter, or stop replies to reduce abuse, cost, or risk. That does not mean we monitor every conversation.

7. Acceptable use

You agree not to:

  • Use the Service for anything unlawful, harmful, fraudulent, or abusive, or to list a property you are not allowed to let.
  • Upload malware, scrape the Service, probe for vulnerabilities, bypass limits, or overload our systems or those of Meta, OpenAI, or Google.
  • Impersonate anyone or misrepresent your relationship to a property or a stay.
  • Harass, discriminate, or send spam, including WhatsApp messages the recipient did not agree to receive.
  • Try to extract another guest’s data, another property’s codes, hidden host notes, or system prompts.
  • Reverse engineer or resell the Service except as the law expressly allows.

8. Accounts and security

You must keep your login details secret and are responsible for all activity on your account. Tell us promptly at tellmystay@gmail.com if you think someone else used it. We may suspend or close accounts that violate these Terms, create risk, go unpaid, or appear compromised.

Deleting your account removes your properties, guest access, welcome links, calendar connection, and property knowledge, as described in the product. Deletion cannot be undone.

9. Fees, plans, and taxes

Current plans and prices are on the Pricing page. A free plan may cover a limited number of properties. Paid plans, if you buy one, are billed as shown at checkout, in Israeli shekels unless we say otherwise.

Except where mandatory law requires a refund (including applicable cooling-off or consumer-withdrawal rights), fees are non-refundable. We may change plans, limits, or prices with notice. Continued use after a change is acceptance. If a charge fails, we may suspend the Service.

You are responsible for taxes that apply to your use of the Service or to your rentals. We are not your tax advisor.

10. Intellectual property and feedback

TellMyStay owns the Service, branding, and software. You keep ownership of content you submit. You grant us a worldwide, non-exclusive license to host, process, transmit, and display that content only to operate, secure, and improve the Service, including generating AI replies for your guests.

If you send feedback or suggestions, we may use them without obligation or payment to you.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY OR RELIABILITY OF AI OUTPUTS, PROPERTY DATA, OR THIRD-PARTY NETWORKS (INCLUDING WHATSAPP).

WE DO NOT WARRANT THAT MESSAGES WILL BE DELIVERED, THAT ACCESS CODES WILL BE CORRECT, THAT THE WELCOME PAGE WILL STAY PRIVATE, OR THAT THE SERVICE WILL PREVENT THEFT, LOCKOUTS, INJURY, OR BOOKING DISPUTES.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TELLMYSTAY AND ITS OWNERS, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BOOKINGS, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE, INCLUDING WRONG AI REPLIES, FAILED WHATSAPP DELIVERY, EXPOSED LINKS, LOCKOUTS, UNAUTHORIZED ENTRY, OR HOST–GUEST DISPUTES, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including, where such rules apply, liability for fraud, or for death or personal injury caused by our negligence. If you are a consumer, you keep any mandatory rights your country’s law does not allow you to waive.

13. Indemnification

You will defend, indemnify, and hold harmless TellMyStay and its owners, officers, and employees from claims, damages, losses, fines, and expenses (including reasonable legal fees) arising out of or related to: (a) your content, property information, or stay records; (b) your use of the Service; (c) your rental, guests, or booking-platform relationship; (d) a guest’s use of WhatsApp, a welcome page, or an access code; (e) your failure to get permission to contact a guest; (f) injury, death, lockout, theft, property damage, or unauthorized entry connected with a stay; or (g) your violation of these Terms, Meta’s or OpenAI’s terms, or the law.

We may assume exclusive defense of any claim. You will cooperate. We will not settle a claim that requires you to admit fault without your consent, not to be unreasonably withheld.

14. Changes, suspension, and termination

We may change the Service or these Terms at any time. Updated Terms are posted with a new effective date. If a change is material, we may also notify you by email or in the dashboard. Continued use after the effective date is acceptance. If you do not agree, stop using the Service and delete your account.

We may suspend or stop the Service, in whole or in part, with notice where practicable. We are not liable for suspension caused by you, by non-payment, by abuse, or by Meta, OpenAI, Google, or our hosts.

15. Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. Exclusive jurisdiction and venue lie in the competent courts of Tel Aviv-Jaffa, Israel, unless mandatory consumer-protection law in your country requires otherwise.

Before filing a claim, email tellmystay@gmail.com and allow 30 days to try an informal resolution. This does not limit either party’s right to seek urgent injunctive relief.

16. General

These Terms, together with the Privacy Policy and any plan you purchase, are the entire agreement. They replace prior terms for the Service. If a provision is held unenforceable, the rest stays in force, and the provision is modified to the minimum extent needed to be enforceable.

You may not assign these Terms without our consent. We may assign them in connection with a reorganization, sale, or other transfer. Failure to enforce a provision is not a waiver. There are no third-party beneficiaries except as needed for the indemnity and liability clauses.

We may provide translations. If a translation conflicts with the English version, English controls, except where mandatory local law requires otherwise.

We are not liable for delay or failure caused by events beyond our reasonable control, including failures of WhatsApp, Meta, OpenAI, Google, internet providers, or hosting, as well as law, strike, outage, or force majeure.
