Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TellMyStay (“TellMyStay”, “we”, “us”, “our”), including our website, host dashboard, guest concierge links, and related services (collectively, the “Service”). By creating an account, using the Service, or sharing a guest link, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use the Service
The Service is intended for short-term rental hosts and their guests. You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a business, you represent that you have authority to bind that business.
2. What TellMyStay provides
TellMyStay is a software tool that lets hosts store property information and offer guests an AI-powered chat concierge via a link or QR code. We are a technology provider only. We are not a property manager, travel agent, insurer, or emergency service. We do not employ hosts and are not a party to any rental agreement between a host and a guest.
3. Host responsibilities
If you are a host, you are solely responsible for:
- The accuracy, completeness, and legality of all property information you enter (including Wi-Fi credentials, access codes, check-in instructions, and house rules).
- Keeping that information up to date.
- Complying with applicable laws, platform rules (e.g. Airbnb, Booking.com), leases, HOA rules, and guest safety obligations.
- Reviewing AI-generated replies before relying on them for critical matters, and responding to guests yourself when needed.
- How you share guest links and QR codes, and who may access them.
4. Guest use
Guests use the concierge at their own risk. Answers are generated from information supplied by the host and may be incomplete or incorrect. For urgent matters (safety, medical emergencies, lockouts, security), guests must contact the host or local emergency services directly — not rely on the chat.
Your stay, payments, damages, and disputes are between you and the host. TellMyStay is not responsible for the condition of any property or the conduct of any host or guest.
5. AI disclaimer
The concierge uses artificial intelligence. AI outputs may be wrong, outdated, or inappropriate even when property data is correct. The Service does not provide legal, safety, medical, or professional advice. Do not use the Service as the sole source for access codes, safety instructions, or compliance decisions.
6. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, fraudulent, or abusive purposes.
- Upload malware, scrape the Service, probe for vulnerabilities, or overload our systems.
- Impersonate others or misrepresent your relationship to a property.
- Use the Service to harass, discriminate, or send spam.
- Reverse engineer or resell the Service except as expressly permitted.
7. Accounts and security
You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at tellmystay@gmail.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose risk to the Service or others.
8. Intellectual property
TellMyStay owns the Service, branding, and software. You retain ownership of content you submit. You grant us a limited license to host, process, and display your content solely to operate and improve the Service (including providing AI replies to your guests).
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUTS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TellMyStay AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BOOKINGS, ARISING FROM OR RELATED TO THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Indemnification
You will defend, indemnify, and hold harmless TellMyStay from claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your content or property information; (b) your use of the Service; (c) your rental or guest relationships; or (d) your violation of these Terms or applicable law.
12. Changes, suspension, and termination
We may modify the Service or these Terms at any time. We will post updated Terms with a new effective date. Continued use after changes constitutes acceptance. We may suspend or discontinue the Service with reasonable notice where practicable.
13. Governing law and disputes
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. Courts in Tel Aviv-Jaffa, Israel shall have exclusive jurisdiction, unless mandatory consumer protection law in your country requires otherwise.
